Official Rules & Regulations of the "Lexus RX 400h Hybrid Luxury SUV" Contest
Participation in the "Lexus RX 400h Hybrid Luxury SUV" Contest (the "Contest") constitutes the entrant's full and unconditional agreement and acceptance of these Official Rules including the decisions of Aviawest which are final on all matters relating to the Contest.
1. Basics of the Contest - The Contest is sponsored and administered by Aviawest. The contest is a unique Internet promotion catering to all current Aviawest users, and all future potential Aviawest users in Canada and excludes residents of the Province of Quebec. No purchase is necessary to enter or win. Maximum one contest registration per person. Duplicate contest registrations will invalidate all entries made by you. Once entered in the Contest, you are automatically entered into and eligible to win the Grand Prize in accordance with the Contest Deadlines noted below.
The Contest has two parts. The first part is the entry by everyone who enters into a draw for a two-year lease of a Lexus RX 400h Hybrid Luxury SUV. The second part involves key blanks being sent to households that book an Aviawest product presentation. One of the key blanks is guaranteed to unlock the door of a plexiglass display box containing a model of the Lexus. The key is guaranteed to be mailed, by an impartial third party, at some point during the Contest.
While it is guaranteed by the contest administrator that the winning key will be mailed, in order to win the Lexus RX 400h Hybrid Luxury SUV, the participant must attend the presentation, then test the key on site. Since there is only one winning key, the chances of winning are dependent upon the individual who receives the key completing their presentation and opening the lock.
By entering the contest, entrant specifically gives Aviawest Resorts Inc, and Aviawest Business Group permission to contact them by email, telephone or mail respecting this and other special offers. When entering the Contest, you can grant Aviawest permission to send you additional promotional materials. Consequently, you have the opportunity to be first in line to receive new and up-to-date information on promotions or events.

2. Who Can Play - "Lexus RX 400h Hybrid Luxury SUV" is open to natural persons who are over 18 years of age and are residents of Canada (excluding Quebec), have Internet access, and a valid email account for the duration of the Contest after entry. Employees of Aviawest, their affiliates and agents, participating sponsors, contractors and immediate family members (defined as parents, children, siblings and spouse) of each such employee, together with those with whom such employees are domiciled are not eligible.
3. How to Enter - To enter the Contest, access the Contest web site at www.aviawest.com/lexus, complete the online entry form in its entirety and click on the submit button. To enter, you must have a web browser that is compatible with Netscape 4.0 or higher; Internet Explorer 5.0; or a web browser compatible with the above-referenced browsers.
In the event of a dispute as to who submitted an online entry, the entry shall be deemed submitted by an "authorized email account holder". Entries will be declared made by the authorized email account holder of the email address at the time of entry. "Authorized email account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
4. Contest Dates - The Contest begins at 12:00:00 am EST on March 1st, 2008 and ends at 11:59:59 pm EST on March 1st, 2009 (the "Contest End Date").
5. What Can I Win - A random draw for the prize will be made by Aviawest on the following date: April 1, 2009.
The Grand Prize is as follows: A Two-Year Lease on a Lexus RX 400h Hybrid Luxury SUV.
The approximate value of all prizes is stated in Canadian Dollars. No substitution or transfer of prizes is permitted except by Aviawest, who, in the event of prize unavailability or any other reason, reserves (1) the right to substitute any prize with another prize of equal or greater value; and (2) the right to substitute cash for any merchandise prize. All taxes, fees and all other expenses and surcharges on prizes are the sole responsibility of the prize winners. Acceptance of a prize constitutes permission for Aviawest and its agencies to use each winner's name and likeness for advertising and promotional purposes in any media without additional compensation unless prohibited by law. Aviawest will not nor does it make any representations or warranties including without limitation, implied warranties of merchantable quality and fitness of any awarded product or prize
6. Notification and Redemption - If you have been drawn as a selected entrant in the Grand Prize draw, you will be immediately notified via email. You must provide proof of identity, within seventy-two (72) hours of notification, or the prize will be forfeited.
Aviawest is not responsible, whether as a result of human error or otherwise, for any failure to contact any selected entrant, so please make sure the information you provide is accurate and current. Each selected entrant will be required to correctly answer a time-limited, mathematical skill-testing, without assistance of any kind, whether mechanical or otherwise, to be declared a winner.
If the selected entrant for any prize is unable to correctly answer the skill-testing question, fails to provide proof of identity, is found to have violated the rules of the Contest or cannot be reached within 3 days of an email being sent to him/her, the selected entrant will be deemed to have forfeited the prize in question and Aviawest will hold a second draw for a new selected entrant and the first selected entrant will be ineligible to claim the prize. All unclaimed secondary prizes after the second draw will not be awarded.
In order to claim a prize, winners must sign and return to Aviawest, Aviawest’s standard declaration of compliance with the contest rules and release form releasing Aviawest and their respective affiliates, subsidiaries, directors, officers, employees, agents and advertising and promotional agencies from and against any and all liability arising from the acceptance and use of any prize, and must pay any applicable taxes, registration costs, insurance, and other expenses.
7. Contest Deadlines - To be eligible for the "Lexus RX 400h Hybrid Luxury SUV" contest prize draws, properly completed entries must be received by no later than 11:59:59 pm EST on March 1st, 2009.
8. Chances of Winning - The chances of winning a prize depend on the total number of eligible entries including additional entries awarded for referring a friend (as specified in section 4 above) received on or before the Contest Closing Date.
The names of the prize winners will be published on this website within 10 days of the close of the contest, subject to verification.
10. Privacy - Aviawest will be collecting personal data about you for the administration of the Contest and for purposes of market research. We use this information to provide entrants with up to date information about Aviawest and the offers made by its business units. We also use this data for market research. Entrants may opt-out of receiving future mailings, however, this does not affect your participation or entries in the Contest. See the removal/unsubscribe section below. No such personal data will be transferred or sold to any third party except in the following circumstances:
When you give Aviawest permission to do so;
When in good faith we believe the law requires it;
Under limited circumstances specifically described to you when we collect the information, such as in the rules of contests, sweepstakes or other promotions;
To our respective agents for data processing purposes, our respective professional advisors and promotional and marketing agencies. Our affiliated companies and their agents and advisors and their respective employees are restricted from using the information for any other purpose other than as described in these Official Rules.
Aviawest may match aggregated, statistical use information to parameters established by third parties, without releasing user information. This information does not contain any personally identifiable information. Aviawest may share aggregate information with trading partners, co-branded sites, participating sponsors and advertisers, however, this aggregated information does not contain personally identifiable information.
The data will be kept on data storage systems in Nanaimo, BC, accessible only by Aviawest. Any requests for access to the information you have supplied, or to update or rectify it, can be made via email to info@aviawest.com.
11. General Terms and Conditions - This Contest is void where prohibited by law and is subject to the laws of the Province of Ontario and the Federal laws of Canada.
By participating in the Contest, each participant agrees to release and hold Aviawest and the employees, officers, directors, shareholders, agents, representatives of Aviawest, their parent companies, affiliates, subsidiaries, advertising, promotion, fulfillment agencies and legal advisers, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including without limitation, any loss, personal injury, death, property damage, and claims based on publicity rights, defamation, or invasion of privacy.
All entries become the property of Aviawest. Aviawest is not responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or from downloading any material from Aviawest's server or from any other Internet web site, regardless of whether the material was prepared by Aviawest or a third party.
AVIAWEST RESERVES THE RIGHT TO CANCEL OR MODIFY THE CONTEST IF FRAUD, TECHNICAL FAILURES INCLUDING ANY NETWORK, SERVER OR HARDWARE FAILURE OR ANY OTHER FACTOR BEYOND AVIAWEST'S REASONABLE CONTROL IMPAIRS THE INTEGRITY OF THE CONTEST AS DETERMINED BY AVIAWEST OR N5R.COM IN ITS SOLE DISCRETION. 12. Restrictions - The following are prohibited and will result in automatic, permanent expulsion from the Aviawest contest: (1) Entering "Lexus RX 400h Hybrid Luxury SUV" under more than one email address at a time; (2) Entering the contest more than once; (3) Viewing or tampering with the Aviawest's system, or its source code or data; (4) Using any method that artificially increases odds of winning; (5) Void in the Province of Quebec and where prohibited; (6) Non-compliance with the official rules of the Contest; and (7) Any other act which Aviawest determines in their sole discretion jeopardizes the integrity of the contest.
